Partners Joseph J. (J.J.) Minioza, Douglas (Gregory) Kilduff, David Frankenberger, and Senior Associate Andrew Chan have been selected for the 2019 Northern California Super Lawyer list.  Super Lawyers rates outstanding lawyers from more than 70 practice areas who have attained a high-degree of peer recognition and professional achievement. The selection process is multi-phased and includes independent research, peer nominations and peer evaluations.

This is the seventh year Mr. Minioza has been acknowledged as a Super Lawyer.  He is also AV® Peer Review Rated Preeminent by Martindale Hubbell.  He is the Managing Partner of the Oakland/East Bay office and serves on the Firm’s Board of Directors.  Mr. Minioza is a trial attorney specializing in defending companies in many different areas of civil litigation, including real estate, employment, personal injury, and commercial disputes.  He has tried over 35 cases to verdict in both state and federal court, achieving a 97% success rate.  He is frequently invited by both his clients and their insurance carriers to give lectures on various areas of law as well as publishing frequently in his areas of practice.

He is the President of the Firm and a member of its Board of Directors.  He is also the Managing Partner of the Sacramento office.  He is AV® Peer Review Rated by Martindale Hubbell.  His practice includes defending construction site injury, motor vehicle, commercial trucking and auto cases, premises liability and products liability cases.

Within his diverse litigation practice, Mr. Kilduff has also defended medical professionals, medical facilities and elder abuse cases.  In addition, he has real estate litigation experience defending the interests of real estate professionals such as home inspectors.  

This is the fourth year Mr. Frankenberger has been acknowledged as a Super Lawyer.  He is AV® Peer Review Rated by Martindale Hubbell.  He is also a member of the American Board of Trial Advocates.  Membership in ABOTA is by invitation only and is limited to those trial lawyers of high personal character with honorable reputations.  Mr. Frankenberger’s practice includes defending complex state court and federal court litigation involving professional liability/errors and omissions; motor vehicle and trucking accidents; personal injury; premises liability; product liability, and construction defect cases for both subcontractors and developers.  In addition he defends healthcare matters, including claims against doctors, nurses, chiropractors and dentists. His products liability experience includes cases for manufacturers, distributors and retailers. Over the course of his career, Dave has successfully tried numerous matters to jury verdict in both state and federal court, including six jury trials to verdict in the past three years.

Mr. Frankenberger has also written articles on Construction Risk Management/Dispute Avoidance and one for the Defense Research Institute’s publication Defense Ethics and Professionalism, titled “Prevent Costly Misunderstandings:  Non-Engagement Letters.” He has given a number of presentations, including at MC2’s Annual West Region Construction Defect & Insurance Coverage Conference in San Diego, California in 2013 and 2015 and the Annual West Coast Casualty Conference in Anaheim, California in 2014.

This is the second year Mr. Chan has been recognized as a Super Lawyer Rising Star which represents the top 2.5% of Lawyers in Northern California.  He has extensive litigation experience representing institutional clients in state and federal court.  His areas of practice include insurance coverage and defense, construction defect, product liability, medical malpractice, personal injury, consumer finance, real estate, contested foreclosures, employment, and other commercial issues. 

Mr. Chan has also completed approximately 40 insurance coverage opinions on matters involving property damage, construction defect, business interruption, loss of use, theft and attempted theft, vandalism, professional errors and omissions, premises liability, personal injury, violation of the Americans with Disabilities Act, the duty to defend, and potential bad faith.  Specific analysis has included coverage, exclusion, and/or limitation for earth movement; wind or wind driven water; seepage; building collapse; pollution; microorganism and mold; protective safeguards; entrustment; prior knowledge; expected or intended injury; volunteer workers; vacant or unoccupied property; ensuing damage; faulty, inadequate or defective design, construction, or materials; wear and tear; rust, corrosion, decay, deterioration, hidden or latent defect, and maintenance; prior wrongful acts; criminal, fraudulent, dishonest, or malicious acts; assault and battery; misrepresentation, fraud, and omissions; and failure to satisfy post-loss obligations.
