Mr. Painter has practiced law for 40 years and has been with Ericksen Arbuthnot for 35 years. He is the Assistant Managing Partner of Ericksen Arbuthnot's Sacramento office. He Chair’s the firm's Products Liability Practice Group and is an active member in the Firm’s Employment Practice Group. He is AV® Peer Review Rated by Martindale-Hubbell.
During his career, Mr. Painter has handled cases involving all aspects of civil litigation and has successfully litigated numerous high exposure cases in both state and federal courts. He has tried 17 civil jury trials and most of those went to verdict. He has tried numerous bench trials and arbitrations. He has mediated many high exposure cases. He successfully defended the first “failure to warn” pharmaceutical products liability case to be tried to verdict in the United States on the issue of whether aspirin causes Reye’s syndrome. He has litigated complex business litigation and class action lawsuits. He has successfully defended wrongful death trucking accident cases in civil jury trials.
He practices in federal and state court in cases involving wrongful termination, discrimination and harassment, disability claims, defamation, privacy, and wage and hour claims. He also represents employers before numerous federal and state agencies including the U.S. Department of Labor, California Labor Commissioner, California Department of Fair Employment and Housing (“DFEH”) and the U.S. Equal Employment Opportunity Commission (“EEOC”).
Additionally, his practice includes commercial business litigation, products liability, professional errors and omissions of healthcare practitioners, real estate brokers and agents, lawyers, financial institutions and insurance compaines, incuding bad faith litigation. He lectures on a variety of legal topics, including document retention and electronic discovery.
He and Marcia have been married for 45 years, raised two wonderful children and reside in Fair Oaks, California with their dog, Hobbes. He and Marcia are avid backpackers.
