Geoff is a partner and shareholder in Ericksen Arbuthnot's Concord office and is a member of the firm’s Construction and Real Estate practice groups. He has worked in the legal profession since 1976 and is AV® Peer Review Rated by Martindale-Hubbell.
He has worked on and handled numerous complex litigation cases, focusing primarily on construction defect and premises liability matters. He has represented owners, developers, general contractors and subcontractors in cases involving multi-tract single family dwellings, apartment complexes, condominiums, townhouses, and multi-story commercial buildings throughout Northern and Central California. Most recently Geoff defended the general contractor in a premises liability/personal injury matter that occurred at a restaurant in Santa Clara County as well as defending a rough grading/drainage subcontractor at a high end single family home also located in Santa Clara County. Over the years he has also defended and prosecuted express indemnity, breach of contract, license bond, and mechanic's lien actions for individuals and companies in the construction trades, as well as defended home inspectors.
Geoff has experience in both jury and bench trials, as well as binding arbitrations. He has participated in hundreds of mediations. Recently he again successfully used the ruling of the Bobrow-Thomas decision to effect a settlement of a general contractor and its subcontractors directly with a plaintiff township, notwithstanding express indemnity owed to the non-settling design professionals.
He has prosecuted a number of private homeowner claims for defective workmanship. He has represented and advised HOAs regarding contractual matters, membership issues, and the sufficiency of their CC&Rs and governing documents. He has advised his commercial clients regarding lease and insurance issues, prosecuted unlawful detainer actions, and assisted them in obtaining and collecting judgments.
Geoff has published articles regarding settling around express contractual indemnity agreements, the impact of the recent case law on the Right to Repair Act, and SB 474. He has given seminars on the use of extrapolation evidence in construction defect litigation and the California Fair Claims Practices Act. He has also participated in providing training to insurance adjusters regarding the ins and outs of handling a construction defect claim in California and the newly decided Tidwell case on coverage for progressive losses not involving water infiltration.
Geoff is an active member and presenter at Western Construction Consultants Association ("Westcon"), an organization of construction forensic professionals. For a number of years he was the Chairperson for Alameda County Bar Association’s annual Bridging the Gap Program. He served as a committee member of the Pleasanton Chamber of Commerce. He is a strong supporter of, and advocate for, the YMCA and for a number of years was a member of the Board of Managers of the Tri-Valley YMCA.
